Terms of Use
These Terms of Use (“Terms”) govern your access to and use of websites, mobile applications, Care Companion, Care Circle features, and related services provided by Parfait Health, Inc. (“Parfait,” “we,” “us,” or “our”) (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy.
Eligibility and accounts
You must be at least 18 years old to create a consumer Parfait account unless your use is specifically authorized through a healthcare or care organization under a separate arrangement. You agree to provide accurate account information, keep your credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity performed through your account unless prohibited by law.
What Parfait does
Parfait helps people capture, organize, review, and share information related to care. Features may include notes, care conversation capture, summaries, follow-through, care organization, resource suggestions, Care Circle sharing, and other tools designed to improve continuity and shared understanding. Features may change as the Services evolve.
Not medical advice or emergency care
Parfait is not a healthcare provider and does not provide medical advice, diagnosis, treatment, or emergency services. Information generated or organized by Parfait is intended to support understanding and communication, not replace professional clinical judgment. Always contact an appropriate healthcare professional about medical decisions. If you believe you are experiencing a medical emergency, call 911 or your local emergency number.
Recordings, summaries, and AI-generated information
If you choose to record or capture a care conversation, you are responsible for obtaining any consent required by law from other participants. Parfait may use automated transcription, artificial intelligence, and other processing tools to create summaries, organize information, or provide requested features. These outputs may be incomplete, inaccurate, or omit important context. You should review important information before relying on it or sharing it with others.
Your care information and content
You retain your rights in notes, recordings, documents, photos, messages, and other content you submit to the Services. You give Parfait a limited right to host, process, reproduce, transmit, and otherwise use that content as reasonably necessary to operate, secure, and provide the Services to you and to people or organizations you authorize. You represent that you have the right to submit the content you provide.
Care Circle and sharing
Care Circle allows you to connect with other people around care. A relationship does not automatically give another person access to all of your information. The care owner controls the ongoing access they grant, and individual items may also be shared directly. If someone grants you access to their care, you agree to use that information only for appropriate support purposes and in accordance with their permissions. You may not use a relationship to obtain access that has not been granted to you.
Follow-through and suggested actions
Parfait may help organize questions, reminders, follow-through, or other suggested next steps. Unless expressly stated otherwise, these items are informational and user-controlled. Parfait does not independently change a clinical care plan, prescribe treatment, or guarantee that a suggested action is medically appropriate. Review questions or care decisions with the appropriate healthcare professional.
Third-party services and resources
The Services may connect to or reference third-party services, healthcare organizations, resources, websites, or applications. Parfait does not control third-party services and is not responsible for their content, availability, practices, or decisions. Your use of third-party services may be subject to separate terms and privacy policies.
Acceptable use
You may not misuse the Services, attempt to gain unauthorized access, interfere with security or operation, impersonate another person, submit content you do not have the right to provide, use another person's care information outside the permissions granted to you, introduce malicious code, reverse engineer the Services except where law expressly permits it, or use the Services in violation of applicable law.
Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information. By using the Services, you acknowledge that personal information will be handled as described in that policy and, where applicable, under separate agreements with healthcare or care organizations.
Parfait intellectual property
The Services, including Parfait software, designs, interfaces, trademarks, logos, documentation, and technology, are owned by Parfait or its licensors and are protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not transfer ownership of Parfait intellectual property to you.
Suspension and termination
You may stop using the Services at any time. We may restrict, suspend, or terminate access when reasonably necessary to protect users, comply with law, address security or misuse, or enforce these Terms. Certain rights and obligations that by their nature should survive termination will continue to apply.
Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will always be available, error-free, or that generated summaries, suggestions, or organized information will be complete or accurate. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Parfait and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services. Any limitation applies only to the extent allowed by applicable law, and nothing in these Terms limits liability that cannot legally be limited.
Changes to the Services or Terms
We may update the Services and these Terms as Parfait evolves. We will post the current Terms here and update the effective date. If a change materially affects your rights, we may provide additional notice where appropriate. Your continued use after updated Terms become effective constitutes acceptance where permitted by law.
General terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. These Terms, together with the Privacy Policy and any applicable written agreement for organization-sponsored use, form the agreement governing your use of the Services.
